The Employers’ Association of Labour Importers warns that thousands of foreign nationals legally employed in Romania are not registered as insured persons in the public health insurance system, despite paying monthly health insurance contributions, and are being denied access to medical services when they need them. According to the association, the issue is not the result of a legislative gap but of an administrative and technical malfunction. Insured status is established in accordance with Article 222 of Law No. 95/2006, and the health insurance contribution is reported through the D112 declaration submitted by the employer. However, the individual’s status in the electronic system is not updated automatically based on this information.

Employers that are members of the association report three recurring situations. The first concerns foreign nationals who are not registered as insured persons even after they obtained their residence permits, despite having their health insurance contributions withheld and paid to the state. The second situation involves individuals who do not appear in the system at all, with corrections possible only if the employer submits a separate written request to the relevant health insurance fund for each employee. Thirdly, employers with a large number of employees report that such requests are either refused or remain unprocessed due to staff shortages within the responsible institutions. As a result, a process that should unfold automatically has become a manual administrative task assigned to employers, making it impossible to complete in a timely manner when dealing with a large workforce.

According to the Employers’ Association of Labour Importers, the direct consequence is that foreign employees pay monthly health insurance contributions but are unable to access medical services, despite having fully complied with their obligations to the state. The National Health Insurance House has confirmed that residence in Romania, as evidenced by a residence permit issued by the Romanian authorities, constitutes the condition for health insurance coverage under the public health insurance system. The association emphasizes that the problem is administrative and technical in nature and can be resolved without any legislative amendments, precisely because the individuals concerned hold valid residence permits and pay the required health insurance contributions, yet are still not registered as insured persons.

The Employers’ Association of Labour Importers points to the lack of integration between the databases of the General Inspectorate for Immigration (IGI), the National Agency for Fiscal Administration (ANAF), and the National Health Insurance House (CNAS). Although information on health insurance contributions and the validity of residence permits is already available in the systems of these institutions, the absence of interoperability prevents the normal flow of data. The association calls for the automatic updating of insured status based on the health insurance contributions already reported through the D112 declaration, thereby eliminating the need for individual written requests. It also calls for interoperability between the IT systems of the General Inspectorate for Immigration, the National Agency for Fiscal Administration, and the National Health Insurance House, which would enable the automatic transmission to the health insurance funds of information on the validity of residence permits and allow for a natural information flow between these institutions.

The association also suggests the introduction of an electronic procedure for the bulk submission of registration/status-update requests, specifically designed for employers with a large workforce, together with a statutory deadline for processing such requests. The proposals include the recognition of insured status throughout the entire period during which health insurance contributions are paid, including the 90-day period provided by the law following the expiration of the residence document, as well as the establishment of a dedicated contact point for employers managing a large number of foreign nationals, pending the implementation of permanent technical solutions.
