Important changes for foreign workers

Following the entry into force on April 27, 2026 of Government Emergency Ordinance no. 32/2026 regarding the access of foreign nationals to the Romanian labour market, the Bistriţa-Năsăud County Employment Agency, north-western Romania, informs employers about significant changes in the certificate issuance procedure regarding labour market availability.
With the entry into force of the new regulatory act, Title I of Government Ordinance no. 25/2014 regarding the employment and posting of foreigners in Romania, approved by Law no. 14/2016, has been repealed. Consequently, the general procedure for issuing employment permits and the condition regarding proof of a domestic labour shortage are no longer applicable to applications filed under the new legislation.
Applications for employment or posting permits submitted prior to the entry into force of Emergency Ordinance no. 32/2026, as well as applications already made and scheduled in the application of the General Inspectorate for Immigration or submitted to its territorial units by the same date, will be resolved according to the previous legislation.
The Agency will no longer issue certificates regarding labour market availability or domestic labour shortages for new applications filed after April 27, 2026, except for situations expressly provided for by the new legal act.
Also, for files currently under review, under the previous legislation, the provisions of OG no. 25/2014 approved by Law no. 14/2016 continue to apply. The Bistriţa-Năsăud County Employment Agency will continue to issue certificates of labour market availability in situations where these are required documents according to previous regulations.
The changes target employers who wish to hire foreign nationals, as well as foreign nationals seeking employment or posting permits in Romania. Persons who submitted applications before the new regulatory act entered into force are not affected by these changes.
