Conditions to legally employ a third country national
The General Inspectorate for Immigration reminds the necessary conditions to legally employ in Romania a worker from a non-EU and non-European Economic Area member state. Employer requirements:
– the company’s activity does not have as its main purpose facilitating the entry of foreigners into Romania;
– the company must have at least one year of experience in the relevant field;
– the vacant positions cannot be filled by Romanian citizens, EU/EEA citizens or permanent residents in Romania;
-the employer must be up-to-date with all tax obligations;
– the company must be active in Romania, in the field the permit is requested for;
– the company has not been penalised for undeclared work or illegal employment in the last 6 months.
When submitting an application for an employment/posting permit, the employer must include proof of payment for the associated fees, along with the other required documents.
